Mayor and Council Rejected Their Recommendation Placing Employee's and Visitor's Health In Jeopardy


RECOMMENDATION
The Committee recommends that the City Council proceed with the construction of the New City Hall facility using Alternative Capital Cost Scenario #1 or #2 and the sale of the current City Hall site upon receipt of a commercially reasonable contract for purchase and sale.



The New City Hail Ad Hoc Committee came together with the purpose of informing the Mayor and Council as to the feasibility of proceeding with the construction of a City Hall facility in Downtown Homestead.

 The Committee was charged generally with evaluating the City Hall project as a business decision and without a predetermined outcome.

After reviewing numerous records and analyses of the current and proposed City Hall facilities three categories of information rise to the surface facts supportable estimates and intangible factors. In addition, certain alternative capital cost scenarios apply. Taken together these factors lead the Committee to make the recommendation.

FACTS

The City of Homestead has a sunk cost in the proposed City Hall site of $6,566,598 This figure includes all expenditures through 2009.

The current City Hall facility requires substantial repair and reconstruction including cleanup of environmental contamination.

The current City Hall site is underutilized.

A sale of the current City Hall site would generate substantial cash its subsequent development would generate substantial ongoing tax revenue and or rental income.

The lease of the current City Hall site is an ongoing option which can provide rental income to the City.

The proposed City Hall site is vacant fenced and is producing neither tax revenue nor any service to the city presenting an eyesore to the district and a liability to the City.

As of September 30, 2009 the New City Hall Fund contained $17,381,147.08

Bids for New City Hall are good until September 2010 but the bidders may rescind if there is a long delay.

A judge on Wednesday denied an attempt by Homestead’s lawyers to throw out a lawsuit brought by former Deputy City Manager Johanna Faddis.

A day after mediation failed to bring consensus, Judge Lester Langer of Miami-Dade Circuit Court said the case should move forward, in part to give lawyers more time to gather evidence for a possible trial.

Faddis sued Homestead in September 2011, claiming that city officials acted negligently, invaded her privacy, intentionally inflicted emotional distress and defamed her by releasing romantic text messages sent to her by her then-boss, City Manager Mike Shehadeh, on city-issued cellphones.

Faddis and Shehadeh have both denied ever being in a romantic relationship.

Since the suit was filed, Faddis’ attorneys have also argued that she was a victim of sexual harassment by Shehadeh, and that therefore the texts were not public record. Attorney Kelsay Patterson points to an exemption in Florida’s public-records law stating that when an alleged victim “chooses not to file a complaint and requests that records of the complaint remain confidential, all records relating to an allegation of employment discrimination are confidential and exempt.”

Patterson claims that his client told the city she would not file a sexual-harassment complaint and keep it a secret in exchange for a severance agreement when she was fired from Homestead in December 2009.

The city asked for the case to be dismissed, arguing that the text messages were public record because they had to do with city business.

The text messages were released after an investigator, hired by the city to look into suspected wrongdoing by Shehadeh, dug up them up as part of his work for the city.

“The disclosure of the investigation and the report were matters of public concern,” attorney Joseph Serota told the judge.

Serota pointed to messages that were both romantic but also dealt with city business, including one in which Shehadeh tells Faddis to take the rest of the day off because he can sense that she is in a “pissy” mood.

“This is not completely personal,” Serota said.

Referring to Shehadeh’s role as Faddis’ superior, Serota later added: “He supervises her. He gives her raises. He evaluates her. How could this kind of relationship not be public business?”

Serota also argued that the case shouldn’t move forward because Faddis has changed her testimony regarding whether she was a victim of sexual harassment. Serota argued that her conflicting testimony should be stricken.

The conflicting statements stem from testimony Faddis gave in a lawsuit that Shehadeh brought against the city for wrongful termination after he was fired. In that case, Faddis said she “didn’t take any offense” to Shehadeh’s texts, according to a transcript Serota read aloud during Wednesday’s hearing.

“There has never been a time when he has harassed me, sexually harassed me,” Faddis said, according to the testimony read by Serota.

But when Faddis gave testimony for her own case, she said she was indeed a victim of sexual harassment.

“I provided a watered-down version of the truth,” she said, according to the transcript read by Serota.
Faddis’ attorney said that she “refused to be used as a pawn” in Shehadeh’s lawsuit because the city had burned her by releasing the damaging text messages, and also that she didn’t want to be used to help the city in their defense against Shehadeh’s case.

WHAT:  Judge Lester Langer will preside over the City of Homestead’s motion for summary judgment in the lawsuitfiled by former Homestead Deputy City Manager Johanna Faddis against the city and six sitting council members.  Faddis claims the city and council violated her privacy when they released copies of private e-mails and text messages that included untoward and unwanted advances from former city manager Mike Shehadeh.  A ruling for the city in favor of summary judgment ends Faddis’ case without the jury trial, already scheduled for October, 2012.
Faddis claims the city was negligent when it distributed electronic copies of Shehadeh’s e-mail, text and BlackBerry PIN messages to six council members in 2010.  The city had previously terminated Faddis due to “reduction in force.”  The messages then appeared in several local news outlets and were used as a basis for news stories in The Miami Herald, The Miami New Times, South Florida Times, The South Dade News Leader and WTVJ, the NBC affiliate television station in Miami.  The city council members and the city’s private investigator were the only parties who had copies of the messages. The suit seeks compensatory damages from all parties.  Further details in original news release.

Fountain Of Ants, Clogged Toilets, Overflowing Garbage And Dirty Sinks Part Of Environment At Stadium

The young athletes discovered to be living at the Homestead baseball stadium were given enough to eat, according to newly released police reports.
But police photos show the Venezuelan teens were using a bathroom with clogged toilets and dirty sinks, a water fountain full of ants and other “untidy” conditions.

Homestead police in late April investigated complaints that the players, recruited for a baseball training camp, were sleeping at the stadium unattended and that they weren’t being fed. The investigation, according to police reports, determined the allegations were “unfounded.”

One of the boys, according to a police report, admitted that “during the early phase of the training camp the food was not as plentiful as expected but that there has been much improvement.” Other players complained the food provided was “too ‘American style’ or too ‘Cuban style’.”
Homestead police did not respond to requests for comment.

Police photos show the locker room where the boys slept looks neat, though the carpet appears to be stained. Twin beds are lined up against the lockers, which served as the boys’ closets. There are blankets on the beds.

But pictures of the bathroom and shower area, described as “untidy” in a police report, show toilets clogged with brown water. The urinals are stained yellow, and one looks like there’s a dead bug plastered to the bowl.

The sinks are stained an orange color. The garbage overflows.
Another photo shows a line of ants marching into the drain of a water fountain.

The complaints came to light when an athlete who had attended the camp complained to the Spanish-language television station Univision about the conditions at the stadium. Homestead city officials investigated, and found the living arrangements violated several city codes and zoning laws.
The Department of Children and Families also was investigating. A spokeswoman there did not respond as to whether DCF’s investigation has ended.

Miami-Dade Fire Rescue officials cited numerous violations at the stadium, such as not having working fire alarms or sprinklers. The young athletes had to move out because of the safety issues. A spokeswoman there wrote in an email that “the violations are still pending.” The city-owned ballpark’s tenant, La Ley Sports, has until Saturday to fix the problems, according to a fire inspection report.

La Ley, without the city’s knowledge, entered into an agreement to let Canadian company Gigante Baseball Group use the stadium to train young players recruited from Venezuela.
Homestead officials in May decided the agreement was a breach of La Ley’s lease with the city, and declared the company to be in default for that and other reasons. La Ley responded with lawsuits, which are still pending.

Ricky Todd, general manager of Gigante, told The Miami Herald in April that the complaints against Gigante came from a player who was bitter after being cut. Another player and the woman responsible for the boys, Romilys Maria Acevedo-Torribilla, gave Homestead police the same theory, according to reports.
Todd did not return a call and text message for comment in the last few days.

Todd has previously provided the Herald with receipts that show hundreds of dollars of food purchases, and a police report noted the boys appeared to be “in good health.”

Gigante has since moved out, according to La Ley owner John H. Ruiz.

John La LEY Ruiz, TV Lawyer Claims Baseball Coaches Ripped Him Off

Ah, baseball. The nostalgic green of the outfield grass. The evocative crack of bat hitting ball. The zeal of litigation and the slow slog of civil justice.

George Will say whaa?!

Three prominent local figures in youth baseball are embroiled in an intriguing lawsuit filed earlier this month. Miami attorney John H. Ruiz -- host of GenTV's Spanish-language financial advice program La Ley -- claims a Miami Killian Senior High School baseball coach and a New York Yankees scout "conspired to commit fraud and purposely lied" to fleece him of $7,000.

Ruiz owns La Ley Sports, a website that broadcasts youth baseball games and records stats and schedules.
Last summer, he says, he was approached by Killian's Angel Herrera and the Yankees' Carlos Marti, who are both coaches for the Florida Legends. The elite travel ball team has included top high-school-age prospects such as Westminster Christian's David Thompson, Mater Academy's Albert Almora, and new Kansas City Royals draft pick Jack Lopez.

But the Legends were out of money, so Ruiz agreed to sponsor the team. It became the La Ley Legends. In return for paying for uniforms, equipment, travel, and tournament fees, La Ley Sports got its name on the team's jerseys and any prize money won by the squad, according to the lawsuit.

You might see where this is going. The La Ley Legends won a national qualifier in a tournament staged by the American Amateur Baseball Congress (AABC), entitling the team to a $7,000 prize. But Herrera and Marti tried to conceal the award from Ruiz, he now claims, and the Killian coach had the organization write the check out to him. He then "cashed the $7,000 award check and shared it with Marti."
Says Ruiz: "They absconded with my money."

Ruiz filed suit May 3. Though there's surely another side to the story, Herrera didn't respond to an email sent to his school account, and Marti didn't return phone messages seeking comment. AABC also didn't return Riptide's calls.

But Miami-area youth baseball is a hornet's nest of weirdness and two-bit corruption. And Ruiz's complaint already includes vague accusations of the Legends breaking Florida High School Athletic Association rules. For this suit, we're going to pick an open bleacher seat, nurse a seven-dollar beer, and watch the action unfold.

Despite Impending Lawsuits by La LEY Two Council Members Vote to Approve Four Year Waiver on Insurance

Translation: Taxpayers Would Fund The Insurance Premiums For La LEY If Bateman And Maldonado Had Their Way

While four council members voted no, two voted yes. Vice-Mayor Burgess, Councilwomen Fairclough-McCormick and Waldman were joined by Councilman Shelley and said no way. Meanwhile Mayor Steven Bateman and sidekick Elvis Maldonado voted yes. It would have cost more than $11,000 per month, a cool $525,000 over four years.


What were they thinking? This is just another example of what is to be expected to occur under "Strong Mayor" Steve Bateman. Prior to the vote John H. Ruiz of La LEY informed the council that two lawsuits were filed late Tuesday afternoon against the City of Homestead by his La LEY Sports entity. Repeat: Mayor Bateman and Councilman Maldonado then voted to pay $525,000 for insurance premiums for a company who has filed lawsuits for millions against the city.

Hard to believe!
