Housing Authority Director Oscar Hentschel Gets Good Reviews

There was the bombshell federal report that blasted financial mismanagement. There were sexual harassment complaints. Allegations of conflicts of interest. Evictions.
Oscar Hentschel’s first year at the helm of the Homestead Housing Authority was a rocky one. On Tuesday, board members gave their first evaluation of the agency’s leader.
Board members had mostly good things to say about their director’s performance: Two said he has done an “outstanding” job. One said Hentschel is “fully capable,” and another said he “significantly exceeds expectations.”
Board Chairwoman Audelia Martinez, however, said the director “needs improvement.” The last board member, Lois Jones, Hentschel’s most vocal critic from the beginning, called for his removal and leveled more claims of incompetence against him.
Jones has said she will not attend more meetings in protest of Hentschel’s leadership. She wasn’t there Tuesday. Instead she sent her comments in a letter.
There was no talk Tuesday of giving Hentschel a raise — the board had previously floated the idea of boosting his $90,000 salary by $35,000. That’s after a $20,000 salary bump the board gave him within months of being hired.
Despite the controversy, there has been some progress.
Hentschel often points to the previous administration as the source of many of the housing authority’s woes. The housing authority gets about $20 million from the U.S. departments of Agriculture and Housing and Urban Development to provide housing for farm workers and rental assistance to low-income renters. The federal government attaches many strings to the money.
Under Hentschel’s leadership, the authority has worked to bring the housing units it manages into federal compliance, in part by hiring an outside management company. He has found accounting errors made in the past, and saved the authority money in part by renegotiating contracts for garbage collection, security and employee benefit packages.
Hentschel also said Tuesday that the USDA has released a $3 million bond it had frozen while investigating the authority’s finances. The money is to build new farm-worker housing.
Hentschel was not present for his evaluation and, reached by phone Wednesday, declined to comment.
“He has done tremendous work for the housing authority,” said Board Member Arturo De Leon. “I’m very, very pleased.”
Here’s a look back on Hentschel’s first year as executive director of the housing authority:
• March 2011: Hentschel is hired from a pool of candidates despite having no relevant experience in public housing.
• May 2011: Board members raise Hentschel’s salary by $20,000.
• August 2011: Board members float the idea of giving Hentschel another $35,000 raise, but ultimately decide against it. Board member Jones questions apparent business ties between the director and another board member, as well as possible personal relationships with other board members, saying there could be conflicts of interest.
• September 2011: The USDA indefinitely postpones the closing of a $3 million bond as the authority’s finances are probed.
• October 2011: Allegations are made public that two employees have accused Hentschel of sexual harassment. A private investigator, hired by the board, found that one of the women recanted, saying she was put up to the complaint by the other. The investigator rejected the other complaint because the complainant refused to talk with her, but the matter is still pending with the Equal Employment Opportunity Commission, Jones said. The complainant was fired.
• November 2011: The USDA releases a report blasting the authority for letting units fall into disrepair while providing employees with cushy paychecks and perks.
• December 2011: In an effort to address issues cited in the USDA report, the authority moves to evict some tenants who don’t qualify for subsidized housing but have nonetheless been approved for assistance in the past by housing authority staff.
• March 2012: Board members vote to hand over control of the authority’s farm-worker housing units to a third-party management company — something the USDA required because the authority was so poorly managed.

County Commission May Have Made Mistake Putting Skittles, "Iced Tea" On Dais

Something you probably won't see in the network news.

Normally, we don't touch these stories but this one was so emotionally charged that the Miami Dade County Commission may have stumbled in their attempt to be P.C. and pander to a large segment of the county in an election year. The tragedy of the Trayvon Martin shooting was fresh in everyone's mind and without the benefit of time and hindsight the politicians reacted, emotionally. There is the problem.




You can bank on the fact that Barbara Jordan, Dennis Moss, Jean Monestime, Audrey Edmondson, "Pepe" Diaz and Board Chair Joe Martinez never heard of "sizzurp, lean or purple drank" these are all southern urban slang terms for a concoction using Sprite or any fruity drink with Jolly Rancher or Skittles candies and a dose of a codeine laced cough syrup or DMX as an ingredient, the drink has to be sipped and that is said to give one a euphoric and relaxed feeling. Some compare it to Ketamine.

In a March 2012 Board of County Commission meeting next to their microphones each commissioner named placed a bag of skittles and in the case of Dennis Moss he added an Arizona Iced Tea in place of the Arizona Watermelon Juice Drink found at the crime scene. The crime scene photos released in the print media show a can of Arizona Watermelon Juice Drink that was purchased by Trayvon and not Arizona Iced Tea, some cynics say that was intentional to call it "iced tea." Sounds like the media which likes to give half of the story and move on. 

Some blogs have gone through Trayvon's text messages posted on social websites and note he was looking for liquid codeine, an ingredient for sizzurp or lean or purple drank. They also found rapper Li'l Wayne was once addicted to the sipping beverage. It must be sipped because some rappers have collapsed and died with their deaths attributed to this dangerous combo. 

A school in the Capitol City held a Skittles and Arizona Iced Tea Trayvon Martin Day Memorial.

Miami-Dade commissioners urge Florida Legislature to take up 'Stand Your Ground' following Travyon Martin's death

Miami-Dade commissioners approved a resolution Tuesday urging the Florida Legislature to convene hearings on the controversial Stand Your Ground law invoked in the Feb. 26 death of Miami Gardens 17-year-old Trayvon Martin.
 
The measure was put forth by Commissioner Barbara Jordan, who represents Miami Gardens, and co-sponsored by Commissioners Audrey Edmonson and Dennis Moss. It calls for legislative hearings and supports Gov. Rick Scott's task force convened following Trayvon's death after being shot by Sanford neighborhood watch volunteer George Zimmerman. Zimmerman has not been charged.

Homestead faces another lawsuit claiming the city invaded the privacy of its employees when officials released hundreds of unedited text messages sent using city cell phones.

Former parks director Robert Landen is the latest to file suit for invasion of privacy, claiming he was forced to resign after the city released a text Landen sent that portrayed him as racist.
Landen’s attorney, Richard Lee Ruben of Kendall, declined to comment.

Meanwhile, the attorney representing former Assistant City Manager Johanna Faddis in another case, also over the release of text messages, has asked a judge to disqualify the city’s law firm from the matter.

Kelsay Patterson, a Tampa lawyer who is representing Faddis, blames the city’s law firm for the release of the text messages. The lawsuit claims Richard Weiss — of the firm Weiss Serota Helfman Pastoriza Cole & Boniske, which represents the city — ordered copies of the leaked text messages be made without the approval of council, and authorized the release of the text messages without reviewing them.

Now, citing attorney-client confidentiality, the city’s lawyers have refused to answer and have instructed at least one council member not to answer how the CDs got into council members’ hands and who distributed them, the lawsuit claims.

Neither Weiss nor his firm are defendants in the suit, but the lawsuit claims Homestead’s lawyers are violating Florida Bar rules that state a lawyer shouldn’t represent someone if the lawyer’s judgment “may be materially limited ... by the lawyer’s own interest.”

Referring to Weiss, Patterson said: “He put the city in that situation because he didn’t do his job.”
Weiss, reached by phone Friday, said: “We have a policy of not commenting on pending litigation.”

The lawsuits are the fallout from Homestead’s tumultuous 2009 election, when a new council swept into office and ordered an investigation into then-city manager Mike Shehadeh. As part of the investigation, the city collected texts sent to and from city employees.

The text messages, which were passed on to several television and print media outlets, revealed that Landen forwarded a text that (edited here) read: “Ur not going to believe this sh*t!!! I got a tattoo of a [racial epithet] on my shoulder, and now my f--king arm quit workin!”

Messages from Shehadeh read like love letters to Faddis, who is married and was Shehadeh’s subordinate. Both Shehadeh and Faddis, through their attorneys, have denied having a romantic relationship.

Patterson contends the texts were not public record, but Weiss in a February 2010 email to city employees writes that any communications that became a part of the investigation into the former city manager are public records.

“They’re protecting themselves,” Patterson said of the city’s law firm

Breaking News! Johanna Faddis v. City of Homestead, et al

A Different W-4 Report Weiss, Wolpin, Waldman and Williams May Hurt City Position 

A motion was filed in the 11th Judicial Circuit Court for Miami Dade County seeking to disqualify the defense counsel law firm of Weiss, Serota, Helfman, Pastoriza from representing defendants.

Johanna Faddis through her attorney Kelsay Patterson claim actions of Weiss Serota Helfman Pastoriza have caused actual conflict with all named defendants.

It is alleged after a Special Call Meeting on February 3, 2010 which determined cause existed to terminate Mr. Mike Shehadeh's employment, Mr. Richard Weiss acting on his own and without City Council authorization directed Acting City Manager Sergio Purrinos to access the City's computer server to retrieve six months worth of cell phone text messages of Mike Shehadeh. Mr. Purrinos was then directed by Mr. Weiss to have the City's IT Department Manager Geraldo "Jerry" Estrada to download and make a copy of those messages.

There is an affadavit of December 5, 2011 from Mr. Purrinos saying that co-defendants (City of Homestead Council members) began requesting copies of the CD that contained the text messages. These messages included intimate sentiments from Mr. Shehadeh to the plaintiff, a married woman. Mr. Purrinos did not know the City's policy or the law governing such disclosure, dissemination  and/or publication of such private phone messages. For these reasons he asked the City's Attorney Richard Weiss as to whether the messages could be released. According to Purrinos, Mr. Weiss stated he had read all of the messages and he personally approved and validated the release of each CD as requested from all of the named defendants (City Council) including Patrick Franklin.  

In a deposition dated June 7, 2010 Mr. Weiss stated he never read any of these text messages. He affirms that nobody from his law firm read any of the text messages. Therefore accepting his word Weiss and his law firm are liable to the City for legal malpractice according to Attorney Kelsay Patterson. They acted beyond the scope of authority authorized by the City and they acted on their independent initiative, they failed to review the "content" of any of these text messages. The only way the text messages ever came into existence in a format to be read, distributed and leaked in their pure and un-redacted form was due in whole part on the actions of Richard Weiss, Esquire and the lawyers in his office according to the motion filed.

It is very important to understand that council members are being advised by City Attorney's during depositions not to divulge who gave them the CDs citing client-lawyer protections.

Now For The Bombshell! 


According to former City of Homestead City Clerk Sheila Paul-Shedd approximately one year earlier in the Spring/Summer of 2009 stated David Wolpin, Esquire of the Law Office of Weiss Serota Helfman Pastoriza would not approve and/or allow co-defendants Judy Waldman and Rev. Jimmie Williams III to have access to the text messages of City Manager Mike Shehadeh. Ms. Shedd describes how her office received a written request from Councilwoman Waldman and then shortly after a second almost identical request from Rev. Jimmie Williams III. An affadavit from Sheila Paul-Shedd notes that she was deposed in Phoenix, Arizona on November 11, 2011. After conferring with David Wolpin Esquire it was decided that the content of these text messages, the only relevant item to consider, was NOT related to the City's business. 

According to the affadavit of Ms. Shedd, approximately 3-5 months prior to the November 2009 elections a written public records request from Councilwoman Judy Waldman was received. The request was asking for all of the private/personal text/pin messages from City of Homestead issued Blackberry cell phones of Mike Shehadeh, Johanna Faddis and a few other council members. Ms. Shedd then sought guidance from David Wolpin, Esquire. The issue of content within the text/pin messages that did not touch upon any of the City's business and execution of matters pertaining to the city determined that the text/pin messages should not be disclosed, produced and/or provided. For that reason Ms. Shedd said she could not satisfy the records request made by Judy Waldman.

A few weeks after Judy Waldman's request was denied a second similar request that was nearly identical to the request submitted by Judy Waldman was received from Jimmie Williams. His request was also denied. Williams was then told to contact the City Attorney Mr. David Wolpin.




Since this needs to be summarized, here goes in one paragraph. According to Ms. Sheila Paul-Shedd the City had already an established policy regarding what was a private and what was a public record based upon content related to text and pin messages in 2009. According to Sergio Purrinos he was directed to ascertain all messages regardless of content in 2010. According to Richard Weiss in 2010, he never read the text messages. City Council members in 2010 were granted text message CDs but are prohibited from saying where they got them from in depositions. At least one council member was told not to answer due to attorney/client privilege. Johanna Faddis and her attorney Kelsay Patterson filed the motion to disqualify Weiss Serota Helfman Pastoriza based upon conflict of a legal nature since they were responsible for the ultimate release of the CDs. 

Something to think about: The Council by not indicating who gave them the CDs are possibly protecting the law firm and yet doing a disservice to the City of Homestead who they represent. This motion for disqualification certainly appears to have some validity to it. 

Please let Homestead know your thoughts, the quantity of documents associated with the motion are voluminous and we look forward to providing the related materials as proof of the motion's merits. Look for them in the next few days.

We waste water brushing our teeth, watering our lawns, keeping golf courses green, and sending our waste water to the ocean preventing our ability to swim in it. As development continues beyond current urban boundaries, we dig more wells, but have no plan to recycle current well water. The ethic described can help us maintain water in the future and prevent possible water wars.

Everglades Preparatory Academy, Literally The Best Named School Ever

Once again another boondoggle looms on the landscape of Homestead, the Everglades Preparatory Academy is going up fast, the first thing that comes to mind when looking at this project is the name. They got it right, if preparing their students for the Everglades as the name suggests is the goal, they have successfully exceeded even the City of Homestead Council's expectations.

This is what you get when the Homestead City Council caves to parent pressure without considerations for doing things the right way. Workers are moving fill to support the roadways entering this project as this is being written. This land was once agricultural and as such it sits a foot or more down from the roadways, this is the result.

Seagulls, egrets, herons are currently flocking to the site off the turnpike because of the newly created lake. Congratulations to all those who were involved in this latest fiasco.
